Child Custody

FamilyChild custody and support tend to be most sensitive and divisive subjects in divorce negotiations because they affect both your emotions and your wallet. Unfortunately, children are used as a bargaining chip. Parents’ responsibility to supervise their children’s growth and development continues even after the marriage ends.

Both parents should help their children understand that although mother and father no longer love each other as husband and wife, they do love each other as parents. It is essential that both parents successfully convey love to their children. As husband and wife, though, working together may be out of the question.

However, as parents, there are always methods of communication available to those who seek them. Whatever method works best for you, remember that it is critical to remind your children that you care about their personal safety and that you love them, regardless of the status of your marriage.

The court determines custody based on what it believes to be the best interests of the children. This can be the most complicated and controversial component of a divorce. Sometimes children become a bartering tool, and concern for their well-being gets lost in the game of tug-of-war.

Custody matters affect children under the age of 18. When parents disagree about issues of custody, the court will often appoint a law guardian who will conduct an investigation and issue a recommendation regarding custody and an appropriate visitation schedule.

Sole Custody: If the parents are not awarded joint custody, one parent will have sole custody of the children. Sole custody means that a parent has the authority to make legal decisions for the children. The non-custodial parent is awarded specific visitation with the children.

Joint Custody: If parents are awarded joint custody, both parents have legal custody, with one parent designated as the primary residential parent. Joint legal custody means both parents have the right to make major decisions for their children. These decisions relate to the child's place of residence, medical and dental treatment, education, child care, religious education, extracurricular activities, summer camp and recreation.

Shared Custody: Shared custody means that both parents share legal custody, with each parent having specific periods of responsibility for their children. This arrangement gives both parents the right to make major decisions on an equal basis for their children.

Modification of Order
In family law, there are four main types of orders that sometimes need to be modified: child support, child custody, child visitation, and spousal support. The court usually has jurisdiction to modify child custody, support and visitation orders well into the future. We have extensive experience in dealing with issues that arise after a marriage has been dissolved. Our experience in these modification proceedings includes everything from alimony and child support adjustments to visitation and custody issues. The firm also represents clients in adoption proceedings and child custody disputes. Our appellate law group also handles marital and family law appeals.
